Protective Orders are designed to keep people safe. But unfortunately, they can easily be misused by an individual who wants to punish the client for a variety of unwarranted reasons, whether that be revenge, delusions, emotional gratification, or the desire to control another. Protective Orders can also be overreaching, even when a small amount of enforcement may be warranted.

One recent client was facing a protective order that was completely unsupported by tangible evidence, although the complainant verbally alleged horrific attacks. Fortunately, even with only a few days to prepare, attorney Tiffany J. Fix was able to gather the key evidence to rebut the opposing party’s allegations. In a hearing that lasted nearly two hours, Tiffany grilled the complainant about prior inconsistent text messages, prior inconsistent actions, motives to fabricate, the lack of witnesses, and many other topics until the case was thrown out.  Our client was able to walk out of the hearing a man free from the cloud of suspicion and distrust activated by these false claims. 

Prior to the hearing, our client was worried about later facing sexual assault criminal charges, given the horrific assaults the opposing party claimed had occurred. However, because the opposing party was interrogated so effectively before they had a chance to fix the holes in the story, it is extremely unlikely that any criminal charges will ever arise. When a complainant fails to even meet the civil protective order standard, that is highly effective in deterring further criminal investigation.
